A new bill authored by State Sen. Bob Hall in the Texas Senate seeks to amend transportation regulations to allow greater axle weight tolerance for certain vehicles on Texas highways, according to the Texas Legislature website.

The bill on Property Interests category, introduced as SB 70 during the 89(1) legislative session on Wednesday, Aug. 6, was formally listed with the short title: ’Relating to the exercise of the power of eminent domain by a political subdivision to take private property outside the political subdivision’s boundaries’.

The following is our breakdown, based on the actual bill text, and may include interpretation to clarify its provisions.

In essence, this bill amends Section 621.101 of the Transportation Code to allow vehicles or combinations of vehicles transporting aggregates over Texas highways or roads to operate with an axle weight that includes a 15% tolerance above the maximum allowable axle weight defined in existing provisions. The total gross weight, however, must not exceed the authorized maximum for the specific roadway. If passed with a two-thirds majority in both legislative houses, the bill will take immediate effect. Otherwise, it will take effect on Sept. 1, 2025.

Bob Hall, the chair of the Senate Committee on Administration, proposed another five bills during the 89(1) legislative session. He is also a member of the Senate Committee on Committee of the Whole Senate, a member of the Senate Committee on Finance, a member of the Senate Committee on Health & Human Services, a member of the Senate Committee on State Affairs, and a member of the Senate Committee on Veteran Affairs.

Bills in Texas go through a multi-step legislative process, including committee review, debates, and votes in both chambers before reaching a final decision. Each session, there are typically thousands of bills introduced, but only a portion successfully navigate the process to become law.
